Right to return products. Consumers may exercise their right of withdrawal from all transactions with ElettroWebStore through www.elettrowebstore.com within 30 days from the date of purchase.

The right of withdrawal to return products purchased from ElettroWebStore may be exercised without penalty and without specifying the reason within the time period indicated.

Those who purchase products as end consumers may exercise the right of withdrawal.

It is a final consumer those who purchase a product for their own personal use and outside their business activity.

All modes of withdrawal set out below are offered in accordance with the Consumer Code, Legislative Decree No. 206 of 6 September 2005.

The 30-day period is calculated from the day on which the consumer or a third party other than the carrier and designated by the consumer acquires physical possession of the goods.

How to exercise the right of withdrawal when returning products

To exercise the right of withdrawal for the return of products, it is sufficient for the consumer to send a communication to ElettroWebStore.

Notice to avail yourself of the right of withdrawal can be sent via the appropriate procedure on this page.

If the procedure does not work, the consumer can send an e-mail to [email protected] clearly stating the details of the transaction:

  • transaction number,
  • date of purchase,
  • buyer's nickname,
  • quality and quantity of the goods subject to cancellation,
  • name who received the goods.

ElettroWebStore will refund all payments received from the consumer, excluding shipping costs, within 14 days. This period begins on the day ElettroWebStore is informed of the consumer's decision to withdraw from the contract.

ElettroWebStore will use the same means of payment that the consumer used for the initial transaction to make the refund, if possible. However, ElettroWebStore will not proceed with the refund until it has received the goods returned by the consumer.

If the delivery costs were included in the price of the item, for shipments within Italythey are conventionally set at a minimum of Euro 10.00 per individual item shipped. For products with a volume of more than 0.20 cubic metres, the shipping cost is estimated by the following formula: (volume of the parcel in cubic metres)x10/0.20.

If the delivery costs were included in the price of the item, for shipments outside Italythey are conventionally set at a minimum of Euro 20.00 per individual item shipped. For products with a volume of more than 0.05 cubic metres, the shipping cost is estimated by the following formula: (volume of the parcel in cubic metres)x20/0.05.

I costs for exercising the right of withdrawal shall always be borne by the consumer. The costs for exercising the right of withdrawal are understood to be the costs necessary to return the product to ElettroWebStore.

The consumer must return the products to ElettroWebStore or to a third party authorised by ElettroWebStore within no more than fourteen days. This period begins on the date on which the customer communicated his decision to withdraw from the contract.

 

Decrease in the value of goods subject to the right of withdrawal

The right of withdrawal gives the consumer the opportunity to verify the nature and qualities of the product when it is delivered to him. It is assumed, in fact, that the consumer cannot physically verify the qualities of the purchased item until it is delivered to him.

The consumer must only handle the goods to assess their characteristics, as if he were in a physical shop.

The consumer is liable for any diminution in value resulting from the handling of the goods necessary to establish the nature and characteristics of what was received.

ElettroWebStore may deny the possibility of exercising the right of withdrawal where the consumer has purchased products that, once opened, are unsaleable.

For example, this is the case with single-use products packaged in multi-packs or products that can be used for food preparation. These items, once opened and used, are no longer fit for sale when used. Who would buy an appliance already used by another person as new?

The consumer acknowledges that the purpose of his right of withdrawal is to enable him to verify the nature and quality of the products. This verification shall be the same as if the articles were displayed in a physical shop visited by the consumer.

Thus, objects that have been tried and used and cannot be considered new cannot be returned.

Such evidence, in fact, by spoiling the product, places the entire burden of exercising the withdrawal on ElettroWebStore. ElettroWebStore would suffer a loss exceeding only the loss of profit from the loss of sale. This makes the exercise of the right of withdrawal unfair.

 

Exceptions to the right of withdrawal for the return of products

Pursuant to the provisions of the Consumer Code, it should be noted that the right of withdrawal is in any case excluded in the following cases.

1) Purchase of food and beverages. Foodstuffs and beverages may not be returned.

2) Purchasing packaged products for the customer. Articles that are manufactured or specially put into production for the Customer or customised according to the Customer's instructions may not be returned. This also applies if the article is part of the catalogue and has standard characteristics but for which the supplier's manufacturing techniques require a specific production order.

3) Purchase of audiovisual products or sealed software. Sealed audio-visual products or computer software, unopened by the consumer, cannot be subject to the right of withdrawal.

4) Purchase of disposable and sealed packaged products. Disposable and/or sealed packaged products that lose their unity and saleability once opened cannot be returned. This is also for hygienic and sanitary reasons.

5) Purchase of products inseparably mixed with other goods. These are those items that, after delivery, are, by their nature, inseparably mixed with other goods. For example, kitchen appliances that, once used, can no longer be restored to their factory state. In this case, ElettroWebStore reserves the right to offer the consumer the possibility of withdrawing from the contract against a fair reduction in value. Essentially, ElettroWebStore offers a partial refund to the customer, i.e. the price of the item reduced by the value of the parts of the product to be replaced in full to restore it to factory condition.
